These Terms apply to the Pepio mobile application (“App”), related websites (including pepio.app), and any optional subscription or in-app purchase offerings we make available (“Services”). Pepio is offered by ZSTACK CAPITAL LLC (“Pepio,” “we,” “us,” or “our”).

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What Pepio is (and is not)

Pepio is a self-tracking and organization tool for logging GLP-1 medications, peptides, and related health information you choose to record (for example, injections, schedules, sites, weight, or symptoms). Pepio does not provide medical advice, diagnosis, or treatment. Any information in the App is for your personal organization and education only. Medication and health decisions belong between you and a qualified healthcare professional. If you have a medical emergency, call your local emergency number.

2. Eligibility

The App is rated 16+ on the App Store. By using the Services, you represent that you meet the minimum age in your jurisdiction and any age requirement we display in the App or store listing. If you use the Services on behalf of another person, you represent that you have authority to do so.

3. Accounts and security

Some features may require an account. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at [email protected] if you believe your account has been compromised.

4. Acceptable use

You agree not to: (a) misuse, disrupt, or probe the Services; (b) attempt to access data or accounts that are not yours; (c) reverse engineer the App except where applicable law prohibits that restriction; (d) use the Services to violate law or third-party rights; or (e) upload unlawful, harassing, or harmful content through any part of the Services.

5. Your content

You retain ownership of information you enter into Pepio (“Your Content”). You grant us a limited license to host, process, back up, and display Your Content solely to operate and improve the Services and as described in our Privacy Policy. You are responsible for the accuracy of Your Content and for having any rights needed to provide it.

6. Subscriptions and payments

Optional paid features (for example, “Pepio Plus”) may be offered through Apple’s in-app purchase system or other payment methods we specify. Payments processed by Apple are governed by Apple’s terms. To the extent we process payments outside the App (for example, via our website), those transactions may be handled by our payment processor; pricing, renewal, and cancellation terms will be presented at purchase.

7. Third-party services

The Services may link to or integrate with third parties (for example, the App Store, analytics, or cloud providers). Those third parties have their own terms and privacy policies. We are not responsible for third-party services.

8. Intellectual property

The Services, including the Pepio name, logos, software, and documentation, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.

9. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT RESULTS FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE FOR ANY CLINICAL OR MEDICAL PURPOSE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZSTACK CAPITAL LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless ZSTACK CAPITAL LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from Your Content or your misuse of the Services.

12. Suspension and termination

We may suspend or terminate access to the Services if we reasonably believe you violated these Terms or if we need to do so to comply with law or protect the Services or other users. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.

13. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. If changes are material, we will provide additional notice as required by law or as we otherwise determine appropriate. Your continued use after the effective date constitutes acceptance of the updated Terms.

14. Governing law; disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where prohibited by the mandatory laws of your jurisdiction. Courts in Delaware (or another forum we specify in a future version) may have exclusive jurisdiction over disputes, unless applicable law requires otherwise.

Important: If you purchased the App through Apple, Apple is not responsible for the App or its content, and Apple has no obligation to provide support for the App. Apple is a third-party beneficiary of Apple’s standard end user license terms to the extent applicable.
